SLIP AND FALL INJURY ATTORNEYS

There are many different types of accident cases and not all lawyers are competent in handling each type of case.  Slip and fall injury attorneys must have specific knowledge of the laws in the locality where the accident took place, especially if that accident occurred on a sidewalk or in a roadway.  Different municipalities have different laws as to whether the municipality or the adjacent property owner is liable.  If a slip and fall accident did involve a sidewalk or roadway there may also be shortened time periods in which you must file a claim so it is extremely important to contact slip and fall injury lawyers who really know how to handle these types of cases right away.  We at Brady & Goldberg are such slip and fall injury attorneys.  We also handle construction accidents, car accidents, other types of accident cases and medical malpractice throughout Westchester (including White Plains, Mount Vernon, New Rochelle, Mount Kisco), Putnam, Rockland, Dutchess, Nassau, Suffolk, Queens, Bronx, Kings and New York Counties. So if you need a slip and fall injury lawyer or an attorney who handles construction accidents we can be reached at (914) 690-0800 or on the web at www.bradygoldberglaw.com.

ACCIDENTS AT WORK

If you are hurt in accident at work such as slipping and falling in your employer’s office because a co-employee had spilled something what are your rights.  The law in New York State prevents you from bringing a law suit against your employer or a co-employee for causing your accident.  For those claims you are limited to being able to file a workers compensation claim to have your medical bills and a portion of your lost wages paid.  However, even if you are hurt at work, if someone other than your employer or a co-employee caused your accident you can bring a law suit against that other party for your injuries.  That includes car accidents, slip and fall accidents or any other type of accident.

WHAT TO DO AFTER A MOTOR VEHICLE ACCIDENT

There are several very important things you should do immediately after you are involved in an motor vehicle accident.  They are as follows:

1. Call the police, have them come to the scene of the accident and prepare a police report.

2. Use either a camera or a cell phone to take pictures of all vehicles involved in the accident while they are still in the same location where they came to rest after the accident.  It is very important to take these pictures showing the positions of the vehicles before anyone moves them.

3.  Obtain the names, addresses and telephone numbers of any witnesses to the accident.

4.  Obtain the names and addresses of both the driver and owner of all other cars involved in the accident.  Also obtain the drivers license numbers of all drivers involved in the accident.

5.  Do NOT make any statements to anyone involved in the accident about how the accident occurred.

6.  Make sure you inform the police of where you feel pain and have them call an ambulance for you.  Also tell the paramedics and the workers in the emergency room where you feel pain.

7.  Be very careful what you say to the police, paramedics and hospital workers about prior injuries you have had, your current complaints of pain and how the accident occurred.  Many otherwise good cases have become problematic because of the notes these types of people make in their records which are contradictory to what you have said.

8. Call a car accident attorney as soon as possible so that your rights will be protected right away.  Delays in contacting a car accident lawyer can only lead to problems with your claim later on.

Please remember that Brady & Goldberg are car accident lawyers who have handled thousands of cases.  It is extremely important to contact car accident attorneys such as Brady & Goldberg who have the knowledge and expertise to properly protect all of your rights and obtain for you the maximum amount of money to which you are entitled.  Brady & Goldberg handle cases throughout New York City and in the surrounding counties including Westchester, Rockland, Putnam, Dutchess, Orange, Nassau and Suffolk.  They can be reached on their website at www.bradygoldberglaw.com or by phone at (914) 690-0800.  IF YOU ARE UNABLE TO COME TO COME THEIR OFFICES THEY WILL COME TO YOU AT YOUR HOME OR IN THE HOSPITAL.

DANGEROUS WORKSITE ACCIDENTS

People who work at construction sites often think that conditions at that worksite are normal when in fact they may cause dangerous worksite accidents and violate the New York State Labor Laws and/or OSHA regulations which are meant to protect the workers.  Workers who are injured while at work due to any type of accident from construction site accidents to auto accidents, truck accidents, slip and fall accidents or any other type of accident are covered for their medical bills and lost wages by workers compensation insurance which is maintained by their employer as a requirement of New York State Laws.

Additionally, a worker who becomes injured on the job due to dangerous worksite conditions may have a claim for their personal injuries, pain and suffering, lost wages and medical bills against the general contractor and/or the premises owner.  The New York State Labor Laws and OSHA regulations are in effect in New York State to protect construction workers who are injured while working and in certain cases even provide for strict liability against both the general contractor and the premises owner.   Such strict liability accidents include those which are related to a height differential between the worker and either the ground or an object that falls and strikes the worker.  Many of these accidents involve the use of ladders or other device where the worker is above the ground.  However, they can also include events where the worker is on the ground and is struck by a falling object at the work site of where the worker is on the ground and falls into a hole or trench which is below ground level.

In any of these or similar types of accidents where someone sustains a personal injury it is absolutely imperative to contact personal injury lawyers as soon as possible after the accident so that a thorough investigation of the accident scene can be done while conditions continue to exist as close as possible to what they were at the time of the accident.  Brady & Goldberg are such New York construction accident lawyers.  Due to the very complicated legal issues which exist pertaining to dangerous worksite accidents it is extremely important to make sure you contact New York construction accident attorneys such as Brady & Goldberg who have knowledge of the law as it relates to these types of cases and handle these types of cases on a regular basis.  New York construction accident lawyers, Brady & Goldberg work with the necessary investigators and experts to thoroughly protect the rights of the worker injured due to dangerous worksite accidents.  Brady & Goldberg can be reached at (914) 690-0800 or on the web at www.bradygoldberglaw.com.   Brady & Goldberg are personal injury attorneys handling cases in all of the 5 boroughs of New York City, Westchester, Putnam, Rockland, Orange, Nassau and Suffolk Counties in New York State.  THEY WILL COME VISIT YOU IN YOUR HOME OR AT THE HOSPITAL IF YOU ARE UNABLE TO COME TO THEM.

ASSAULT & BATTERY

If someone assaults you in addition to the criminal charges they may face they may also be liable to you for monetary damages.  Those monetary damages include lost wages if you have missed time from work, medical bills which you have incurred and sums for pain and suffering.  Additionally, since an assault is an intentional tort and not negligence you may also recover punitive damages against the person who assaulted you which may far exceed all the other damages you are entitled to.  If the person who assaulted you has assets this can be a very lucrative claim against them.  Unfortunately, for the person committing the assault they will NOT be covered by insurance for this because this type of tort is an intentional act and not one of negligence.

It is extremely important to press criminal charges against someone who assaults you.  If they are convicted of a crime or plead guilty to a crime it makes it much easier to prevail in a civil law suit for monetary damages because there is a higher burden of proof required in the criminal proceeding.

The law firm of Brady & Goldberg handles these types of cases in Westchester, Putnam, Rockland, Dutchess and Orange Counties as well as within New York City and Long Island.  You should contact Brady & Goldberg at 914-690-0800 or on the web at www.bradygoldberglaw.com as soon as possible after such an incident so that a proper investigation can be done while evidence is fresh and witnesses are easily reachable as well as so contact with and cooperation with the District Attorneys office can be used to your advantage in your civil case.

LIABILITY FOR SERVING ALCOHOL

In New York State there is a law which is referred to as the “Dram Shop Law” which states that if a bar (or for that matter a homeowner having a party) knowingly serves alcohol to someone who is drunk and that person then gets into their car and has a motor vehicle accident, the bar (or homeowner) is liable for any injury caused by the intoxicated person.  An accident attorney should be contacted immediately after any such event so that an investigation can be conducted and witnesses located while information and witnesses are still available.

Trip and Fall on Steps

We just recently were contacted by a client who had tripped and fallen due to a step which was in violation of local codes and was also in a location where the step was not readily visible. Additionally it also did not have any warning of its existence such as a yellow stripe at the edge of the step. In such circumstances the property owner is liable for any injuries sustained by someone due to that type of condition.
